Thanks for visiting RossCharnock.com. Ross Charnock Photography (“Ross Charnock”, “we”, “us” or “our”) respects your privacy. When it comes to your personal information, we believe in transparency, not surprises. That’s why we’ve set out below what personal information we collect, what we do with it and your choices and rights. By using any of Ross Charnock Photography’s services, you confirm you understand our Privacy Policy below stated below as well as our Terms of Service which are sent out with each invoice.
1. Some key terms
In our Privacy Policy, when we refer to “Clients”, we mean companies and brands, or individual persons who use our Services, including visitors to our sites. We explain who we are in the “About us”.
2. How does this Privacy Policy apply?
This Privacy Policy describes what we do with personal information that we collect and use for our own purposes, such as your geographical reports generated through our third party website supplier “Squarespace” and information about how you use and interact with our Website, including information you submit through our Contact form.

3. Personal information we collect
We collect various personal information regarding you or your device. This includes the following:
Information you provide when contacting us, specifically email address, contact information, first name and last name.
The emails and other communications that you send us or otherwise contribute in our “Contact” form section. This is at all times kept private and not distributed or re-sold in any way or form.
Information you share directly with us in connection with surveys, contests or promotions.
Information from your use of the Website and pages. This includes: IP addresses, preferences, web pages you visited prior to coming to our or our Users’ sites, information about your browser, network or device (such as browser type and version, operating system, internet service provider, preference settings, unique device IDs and language and other regional settings), information about how you interact with the Website and our pages (such as timestamps, clicks, scrolling, browsing times, searches, transactions, referral pages, load times, and problems you may encounter, such as loading errors).
4. How we collect personal information
We obtain personal information from various sources. We do this in three main ways:

We record some of it automatically when you use our website (including with technologies like cookies).
Through our social media channels such as Instagram & Facebook.
5. How we use your personal information
We use the personal information we obtain about you for the following purposes:
Point of contact for sending out our estimates, and proposals.
Communicating with you. Communicate with you, including by sending you emails about your requests on our site.
Surveys and contests. Administer surveys, contests and other promotions from time to time.
Customising the Services. Provide you with customised services. For example, we use your location information for future specials or travel dates in order to bring you our services when most relevant.
Improving our Services. Analyze and learn about how our website is accessed and used, evaluate and improve our usability. We usually do this based on anonymous information which does not focus on you individually. For example, we learnt that most clients view our first three “work” Portfolio posts before contacting us through our form.
Enforcement. Enforce our Terms of Service and other legal terms and policies.
Complying with law. Comply with applicable legal requirements, such as tax and other government regulations and industry standards, contracts and law enforcement requests.
We process your personal information for the above purposes when:
Consent. When you fill in our form you have consented to Ross Charnock Photography getting in contact with you. If you no longer want to use our service you can withdraw at anytime by contacting us at hello@rosscharnock.com.
Performance of a contract. We need your personal information to provide you with a custom invoice and contract.
Legal obligation. We have a legal obligation to use your personal information, such as to comply with applicable tax and other government regulations or to comply with a court order or binding law enforcement request.
6. How we share your personal information
We share personal information in the following ways:
We use a third party host, namely Squarespace.com
Following the law or protecting rights and interests. We disclose your personal information if we determine that such disclosure is reasonably necessary to comply with the law, to protect our or others’ rights, property or interest or prevent fraud or abuse of Squarespace or our Clients. In particular, we may disclose your personal information in response to lawful requests by public authorities, such as to meet national security or law enforcement requirements.
Business transfers. If we're involved in a reorganisation, merger, acquisition or sale of some or all of our assets, your personal information may be transferred as part of that deal or the negotiation of contemplated deals.
7. Social media Policy & Usage
We adopt a safe and responsible Social Media Policy. While we may have official profiles on social media platforms, users are advised to verify the authenticity of such profiles before engaging with, or sharing information with such profiles. We will never ask for personal details on social media platforms. Users are advised to conduct themselves appropriately when engaging with us on social media.
8. Models and production team captured in photos
A photograph may in some instances constitute a form of personal data where they can be processed to allow “the unique identification or authentication of a natural person”. Ross Charnock Photography will never photograph an individual as a means of unique identification or authentication unless consensually contracted to do so through an agency or with the provision of a model release form.
The taking of photographs on set of the production team in behind the scene footage, when viewed as a form of processing personal data is necessary for the legitimate interests of Ross Charnock Photography as a photography business unless there is a good reason to protect a given individual’s personal data which overrides those legitimate interests. Clients are therefore requested to direct their production team to read this privacy policy in advance of the event and to advise them to contact us in advance with any concerns around being photographed for security or privacy reasons.
At no point shall any photos taken by Ross Charnock Photography be used to generate income through third party services such as Stock sites, unless explicitly agreed upon by all persons involved and depicted in said photographs.
9. Children’s online privacy protection rules
We believe it is important to provide added protection for children online. We encourage parents and guardians to spend time online with their children to observe, participate in and/or monitor and guide their online activity. Ross Charnock Photography does not knowingly collect any personally identifiable information from children under the age of 18 year old and we do not specifically market to children under the age of 18 years old.
10. Display of images
We may display any photographs to promote Ross Charnock Photography on the Ross Charnock website and blog, on social media, on blogs, on commercial photography related websites, in advertising, brochures, magazine articles and other such material, providing that the images used are used lawfully and without damage to Ross Charnock Photography’s client(s). The rights of the people captured in these photographs are protected by Ross Charnock Photography as detailed in the Terms of Service contract provided to Ross Charnock Photography’s clients. If any image is in likeness of you and you would like it removed you are welcome at any time to send us a email: hello@rosscharnock.com and we will review and remove the image in question.
11. Client Galleries
Ross Charnock creates a client gallery for each client to whom photos are delivered as part of the services contracted. Our client galleries are externally hosted by Pixieset. Their privacy policy can be found here: https://pixieset.com/privacy/
To download from a Ross Charnock’s client gallery you will be required to enter personal data (namely your email address) and a password. Your personal data (email address) will be stored within Pixiesets’ secure system.
Only Ross Charnock will have access to your personal data (email address) stored on Pixieset’s system on behalf of Ross Charnock Photography. It will only be used as detailed above, and will not be used for any other marketing purposes and will not be passed onto any third parties. Pixieset’s technical support team will have the means to access to your personal data (email address) but will never access or share this data other than by request from Ross Charnock Photography.
